F1申請綠卡 EB3時程分享（含準備材料/面試問題/I485配偶送件/EAD時程）

以下分享R先生和我的綠卡申請流程，走EB3申請，Service Center跟Interview office在北加州，配偶同時一起送件I485。文中附上加急方法（找議員，打電話等）、面試問題、準備資料、跟收到可以工作的EAD卡時程。

申請身份（兩人都是台灣人）

04/25/2017 EM asked immigration team to start the GC process.
06/06/2017 PERM – initiation. 08/10/2017 PERM – job description finalized.
12/05/2017 PERM – PWD received. 01/31/2018 PERM – recruitment period finished.
04/04/2018 PERM – filed. (priority date) 08/16/2018 PERM – approved.
10/18/2018 I140/I485/I765/I131 – filed. 10/26/2018 I140 – approved.
11/09/2018 I485/I765 – biometrics appointment scheduled.
11/29/2018 I485/I765 – biometrics appointment. 12/19/2018 I765/I131 (spouse) – approved.
01/09/2019 I131 – approved. 02/04/2019 I765 – approved.
05/31/2019 I485 – interview scheduled. 07/05/2019 I485 – interviewed and approved.
07/12/2019 I485 – GC received.

下面是律師要我們面試準備的材料，我覺得非常有用，給大家參考。

Your original appointment letter (candidate and spouse)
Driver’s License (candidate and spouse)
EAD / AP combo card (candidate and spouse) ·Including any expired EAD Cards (e.g. F1 OPT)
Social Security Card (candidate and spouse)
Your most recent I-94 record (candidate and spouse)
Your Federal tax returns for the past 2 years (only one copy needed if filed jointly)
Form W-2s
Updated letter from your employer confirming your employment and salary
3-4 Recent Paystubs/Pay statements
I-797 I-140 Approval Notice (soft copy is fine)
Valid Passport (candidate and spouse)
Expired passports that you have used to travel into the U.S. (candidate and spouse)
Original Birth Certificate, with English translation (if applicable) (candidate and spouse)
Original marriage certificate with translation (if applicable)
Evidence to show that your marriage is bona fide (if married):
- joint bank or credit card statements
- lease or evidence of joint property ownership
- insurance beneficiary information, photos
Most recent I-20
If you can bring all prior I-20s that will be the best practice

[註1] 後面有括弧寫candidate and spouse的就是兩人都要帶，沒有特別寫的，就是主申請人帶就可以。

[註2] 有加紅色顏色的，是我們實際面試當天有被要求要看的。

從收到面試通知到實際面試大約是一個月，面試當天會安檢，流程大概跟機場安檢差不多。我們面試那天人很多，安檢整個大排長龍，排到樓外去了，請大家留點時間給安檢，不要不小心遲到就不好了。很幸運的是被問的都是非常基本的題目：

面試完給了我們一張單子，說2到4週會有面試結果，但是我們離開半小時就收到Status Update成New Card Is Being Produced，一週後就收到綠卡了，算是效率蠻高的XD

[EAD 加急] 當初配偶的combo card比主申請人還早下來，明明就是一起送出申請，但R先生的EAD卡卻遲遲沒被approve。

因為當時OPT快要過期了，R先生很著急地想盡辦法想讓他快點下來，於是就聯繫了轄區內的congresswoman還有加州的兩個senator。

Congressman/Congresswoman 基本上你要上網用你的zipcode去查，看管你轄區的是誰。

Senator就比較簡單，直接Google你的州名和Senator就可以，一個州只會有兩個Senator。

找到後就去他們的官網上找他們的聯絡方式，基本上都會有個移民專區，告訴你怎麼聯繫他們。我遇到的都是線上填個問券，然後留自己的email，他們過幾天會回覆你。

幾本上議員本人不會自己回覆你，都是底下的工作人員跟你聯繫。他們會寄給你一張表，你填完要簽名再傳回去給他們。然後他們就會幫你打電話給移民局幫你「關切」一下。

除了聯絡議員，你也可以打給USCIS自己加急，但是電話要等很久，我打了幾次都等了40幾分鐘才接通。自己加急的話要跟接線員說明加急的理由，理由不能自己亂掰， USCIS官網上有列出4種他們接受的理由：

Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure to: – File the benefit request or the expedite request in a reasonable time frame, or – Respond to any requests for additional evidence in a reasonably timely manner;
Urgent humanitarian reasons;
Compelling U.S. government interests (such as urgent cases for the Department of Defense or DHS, or other public safety or national security interests); or
Clear USCIS error.

大家打電話前先看清楚是否自己的情況符合上面任何一條，不然可能會被接線員打槍，這樣就浪費很多時間了。
